Have you experienced the challenges of software project delay and disagreement as to cause and responsibility? Then you are not alone. The long-standing Chaos reports by the Standish Group analysed at scale software projects globally and concluded software project success rates are approximately 30%, 50% are challenged and 20% fail.
In 20 years’ advisory experience in multiple markets supporting customer or supplier teams in relation to the development and provision of software solutions, avoiding contract disputes and preserving commercial relationships has often been at the centre of my work.
In collaboration with the NZIAC (New Zealand International Arbitration Centre), I am pleased to announce the creation of a new service model centred on governance and conflict mitigation processes. It encourages and enables the resolution of software project delivery disagreement and reset for a successful outcome. My thanks to John Green and the NZIAC team for this collaborative endeavour.
Following extensive consultation with industry stakeholders internationally and in Aotearoa New Zealand, the service model is based on easily adoptable Contract Modules that can be blended into Agile or Waterfall software project contracts.
These “best for project“ Modules centre on governance and conflict mitigation processes and include:
– Prompt notification of a software project risk event.
– Encouraging customers and suppliers to exhaust their efforts to self-solve disagreement. When struggling to do so, then to obtain support from an industry-knowledgeable neutral mediator or an adjudicator who will make a determination for a complex technical and/or monetary subject matter.
